Summer school “Economic and social rights of migrant children in the European Union” – June 2022

The Summer School Economic, social and cultural rights of migrant children in the European Union aimed to offer specific expertise on the rights of migrant children, with a specific focus on economic, social and cultural rights. This course was characterised by a strong interdisciplinary approach to migration, with particular attention to the jurisprudence of the European Court of Human Rights and the Court of Justice of the European Union as well as to the current challenges for the protection of migrant children’s rights. Relevant case studies will also be presented thanks to the interventions of experts and practitioners in the field. In addition to the lectures, debates were organised in order to foster the exchange between lecturers and participants. 

The Summer School was designed for the following categories of recipients: professionals (such as: public officers, lawyers, consultants, legal operators, social workers, guardians); academics, Ph.D. students and students with a general knowledge of the matter and intending to upgrade their knowledge and competences.

Participants acquire da broad knowledge of the rights of migrant children both for scientific research purposes and for their professional skills. 

In particular, participants were provided with: 

- an advanced insight on the international and EU law on migrant children’s rights, with a particular reference to international covenants and regional treaties (such as the UN Convention on the Rights of the Child, the UN Refugee Convention, the European Convention on Human Rights); 

- a practical and immediately applicable knowledge, using a multidisciplinary perspective, on the economic, social, cultural rights of migrant children, offering also an overview of the relevant case law through case study analysis;

- an overview of the current challenges to migrant children’s rights, such as climate change and environmental degradation, unequal access to education and healthcare, socio-economic discrimination, among others. 

The most relevant issues arising from the EU Pact on Migration and Asylum, from the EU Strategy on the Rights of the Child (2021-2024), from the EU Child Guarantee and from the CoE Strategy for the Rights of the Child (2022-2027) were discussed during the lectures, providing participants with all the relevant teaching materials (regulations, case-law, reports, etc.).

Trainers were academics and experts from European Commission, International Commission of Jurists, UNHCR, the UN Refugee Agency, Save the Children Italia, IOM, ecc.

The course was enriched by the training materials developed in the FAIR project (Fostering Access to Immigrant children’s Rights), and available here, and in the FAIR Plus project (Fostering Access to Immigrant’s Rights – Practical training for Lawyers and jUdgeS) and available here. Both projects were funded by the European Union and coordinated by the International Commission of Jurists. 

Case studies sessions and Q&A sessions were planned in order to stimulate the exchange between trainers and trainees, promoting the creation of a network among all the participants. Specific attention was paid to the case law of the European Court of Human Rights and the Court of Justice of the European Union, as well as to case-law and standards of international law and UN treaty bodies.

The Summer School was held online from 22 to 30 June 2022, for a total amount of 40 hours.

The first session of 22-24 June 2022 provided a strong theoretical understanding of the socio-economic and cultural rights of migrant children in international and EU law, including a focus on the right to development and migrant children’s health, social assistance, housing and healthy environment.

The second session of 27-30 June 2022 provided practical knowledge and expertise of the socio-economic and cultural rights of migrant children, focusing on migrant children’s vulnerability to social and economic discrimination, prohibition of labour exploitation, trafficking and smuggling and migrant children’s right to education and religion.
